1. Acceptance of Terms

By downloading, installing, or using the Mawadda mobile application ("Mawadda" or the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legal agreement between you ("you" or "User") and Qordova Inc. ("we," "us," or "our").

2. Eligibility

You must be at least 18 years old to use Mawadda.
By using the App, you represent that you meet this age requirement.
You must provide accurate, complete information when creating an account.

3. Account Registration and Security

You may sign up using Google Sign-In, Apple Sign-In, or email/password.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You must notify us immediately at social@mawadda.app if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

Mawadda is an Islamic relationship wellness app designed to help Muslim couples strengthen their bonds. The App provides:

Daily Questions - Thoughtful prompts inspired by Islamic teachings for couples to reflect on together.
Deal Breakers - A tool for identifying core values and non-negotiable boundaries.
Partner Pairing - Secure connection between two partners via invite codes.
Wali (Guardian) Mode - Optional chaperone oversight for couples in courtship or engagement.
Games and Activities - Trivia, camera roll challenges, and other couple-oriented activities.
Memories - A shared photo journal for meaningful moments.
Sticky Notes and Voice Notes - Tools for leaving messages for your partner.
Barakah Seeds - A gamification system rewarding consistent engagement.
Home Screen Widgets - Quick-access widgets for daily reflections and partner updates.
Conflict Resolution (Sulh Mode) - A guided workflow for resolving disagreements.

5. User Conduct

You agree NOT to:

Use the App for any unlawful, abusive, harassing, or fraudulent purpose.
Impersonate another person or misrepresent your identity.
Upload content that is obscene, defamatory, threatening, or violates the rights of others.
Attempt to reverse-engineer, decompile, or hack the App.
Circumvent or manipulate security features, including row-level security restrictions.
Use automated scripts, bots, or scrapers to access the App.
Exploit bugs, vulnerabilities, or loopholes rather than reporting them to us.
Use the App to spam, deceive, or manipulate other users.
Share your account credentials with others.

We reserve the right to suspend or permanently ban any account that violates these rules, without prior notice.

6. User-Generated Content

6.1 Ownership

You retain ownership of all content you create within the App (answers, photos, notes, voice recordings). By submitting content, you grant Qordova Inc. a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the App's features to you and your connected partner.

6.2 Content Standards

All content you submit must comply with Islamic adab (etiquette) and general decency standards. We reserve the right to remove content that violates our community guidelines or these Terms.

6.3 No Guarantee of Storage

While we take reasonable steps to protect your data, we do not guarantee indefinite storage of user-generated content. You are responsible for maintaining your own backups of any important content.

7. Partner Pairing and Wali Access

Partner pairing is voluntary. By entering and accepting a pairing code, both users consent to connect.
Wali access is optional and user-controlled. When enabled, the Wali can view daily question answers, voice notes, deal breaker responses, and couple activity.
Either partner may disconnect from a pairing at any time.
Disconnecting or deleting your account will notify your partner and reset their pairing status. The notification is anonymized.

8. Subscriptions and Payments

8.1 Free and Premium Tiers

Mawadda offers both free and premium features. Premium features require a paid subscription.

8.2 Billing

Subscriptions are processed through the Apple App Store or Google Play Store.
Payment is charged to your App Store or Play Store account.
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
Prices are set in the respective app stores and may vary by region.

8.3 Cancellation and Refunds

You may cancel your subscription at any time through your device's subscription management settings (Apple Settings or Google Play).
Cancellation takes effect at the end of the current billing period. You will retain premium access until then.
Refunds are handled by Apple or Google per their respective refund policies. Qordova Inc. does not process refunds directly.

8.4 Free Trial

If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

9. Advertisements

The free tier of Mawadda may display advertisements through Google AdMob. We make reasonable efforts to ensure ads are appropriate but cannot guarantee the content of all third-party advertisements. If you encounter an inappropriate ad, please report it to social@mawadda.app.

10. Intellectual Property

10.1 Our Property

The Mawadda app, including its design, code, logos, branding, question content, game mechanics, and all other original materials, is the property of Qordova Inc. and is protected by applicable intellectual property laws. You may not copy, redistribute, or create derivative works from our materials without written permission.

10.2 Third-Party Content

Trivia questions sourced from the Open Trivia Database are used under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0) with attribution to PIXELTAIL GAMES LLC.
Seerah quiz content is used with permission from the Islamic Info Center and ABM Quran Notes.
Map data is provided by OpenStreetMap contributors under the Open Database License.

11. Account Deletion

You may delete your account at any time through Settings > Delete Account.
Account deletion requires re-verification of your identity (password or OAuth token).
Deletion is immediate and permanent. All your data, including your profile, answers, memories, photos, voice notes, game history, and stored files, will be permanently removed from our systems.
Your partner will be notified anonymously and their pairing will be reset.
This action cannot be undone.

12. Disclaimers

Mawadda is provided "as is" and "as available," without warranties of any kind, whether express or implied.
We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
Mawadda is not a substitute for professional marriage counseling, therapy, or Islamic scholarly advice. The content in the App is for educational and relationship-building purposes only.
We are not responsible for the actions, behavior, or decisions of any user, including your connected partner or Wali.
We do our best to verify the Islamic authenticity and scholarly accuracy of our content, but users should still consult qualified Islamic scholars for religious rulings.

13. Limitation of Liability

To the fullest extent permitted by applicable law:

Qordova Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total liability for any claim related to the App shall not exceed the amount you paid us (in CAD) in the 12 months preceding the claim.
This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).

14. Indemnification

You agree to indemnify, defend, and hold harmless Qordova Inc., its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

Your use of the App.
Your violation of these Terms.
Your violation of any third-party rights.
Content you submit through the App.

15. Governing Law and Disputes

These Terms are governed by the laws of the Province of Manitoba, Canada, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the App will be resolved through binding arbitration in Manitoba, Canada, except where prohibited by law.
You agree to attempt informal resolution by contacting us at social@mawadda.app before initiating formal proceedings.

16. Modifications to the Service

We may modify, suspend, or discontinue any part of the App at any time without prior notice.
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date and, for significant changes, notify you through the App.
Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

17. Termination

You may stop using the App at any time by deleting your account.
We may suspend or terminate your access if you violate these Terms or engage in behavior that is harmful to other users or the integrity of the App.
Upon termination, your right to use the App ceases immediately. Sections 6.1, 10, 12, 13, 14, and 15 survive termination.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Qordova Inc. regarding your use of Mawadda.
